Colorado Safety Policy Information

This section contains relevant information regarding the safety policies and reporting procedures adopted by Iumob S.r.l. (“Data Controller” or “Controller”), in accordance with the applicable law of the State of Colorado. Please also refer to the Guidelines, Terms and Conditions, and Safety Tips to ensure a safe and respectful experience on the app (“Yooppe”).

The Controller’s policies on sexual violence and conduct that threatens personal or public safety

The Controller is committed to maintaining a safe and respectful environment for all Users. Within Yooppe, behavior such as harassment, sexual violence, stalking, or any other conduct that may endanger personal or public safety, whether in online or offline interactions, will not be tolerated.

Any sexual activity without consent constitutes a violation of the Data Controller’s rules and also constitutes unlawful conduct. Such behaviour may result in legal consequences, including civil and criminal liability. In the event of criminal investigations by the competent authorities, the Controller will cooperate with law enforcement agencies.

How to report conduct or content that the User believes violates the Controller’s rules

Users can easily and immediately report any content or behaviour they believe to be in breach of the Controller’s rules through Yooppe or by contacting customer support directly here.

It should also be noted that submitting false reports, made with malicious, discriminatory or otherwise improper intent, constitutes a breach of the Terms and Conditions and may result in measures being taken against the account of the User responsible.

Does the Controller verify Users’ identities or check their criminal records?

The Controller uses a profile photo verification feature within Yooppe and, in countries where the law expressly requires it, also carries out identity verification.

The Controller does not carry out systematic checks on criminal records or verify the identity of all registered Users. However, Controller may carry out limited checks by cross-referencing certain information with public registers relating to sexual offences, provided that it has the necessary data. Accounts linked to Users with a criminal record for sexual offences are deactivated.

No identity verification or criminal record check can absolutely guarantee the absence of risks. For this reason, it is important to always exercise caution when interacting with new people, both online and offline.

Can individuals who have been convicted of a crime use Yooppe?

Yooppe’s Terms and Conditions do not permit access to Yooppe by individuals who have been convicted of, or have committed, serious offences, in particular those involving violence or unlawful sexual behaviour.

If the Controller becomes aware of a criminal record that makes a User ineligible for Yooppe, the account will be deactivated.

What happens to a User who is reported for violating the rules?

All reports of misconduct are taken seriously and promptly reviewed by the Controller. If it is determined that the Terms and Conditions or the Guidelines have been violated, appropriate action will be taken. Depending on the severity, the consequences may range from a warning to the suspension of the account or a ban on using the account. The most serious violations, such as violence, threats of violence, sexual misconduct or other particularly harmful behaviour, will result in a ban from Yooppe.

When a report of misconduct is received, are the User’s contacts notified?

Generally, contacts are not informed when a User is reported or subject to measures. However, in accordance with certain local regulations, email notifications may be sent to the Users concerned when an account is suspended due to confirmed or suspected fraudulent behaviour, namely situations in which the User poses a significant risk of engaging in fraudulent activities through the use of false identities or attempts to obtain money or other benefits by deceptive means.

Information relating to a User’s account, as set out in the Privacy Policy, is disclosed only in limited circumstances, primarily to comply with legal obligations, such as requests from judicial authorities or other obligations provided for by law.
